                       A legal disclaimer - Disclaimer and policies

  • Liability & Assumption of Risk

    • A waiver stating attendees participate at their own risk, especially given outdoor variables (wind, terrain, flying kites etc).

    • Release of claims against organisers, the venue (Desert Breeze Event Center) and sponsors for injury, damage, loss.

    • Statement that the event may be modified, delayed or cancelled due to weather or other conditions.

  • Ticketing & Refund Policy

    • Conditions around ticket purchase, usage, non-transferability, admission rules.

    • Refunds (or lack thereof) in case of cancellation, postponement, or weather disruption.

    • Re-entry rules, lost ticket handling.

  • Photography & Media Release

    • Notice that photos/videos may be taken at the event for promotional use.

    • Implicit/explicit consent of attendees (or minors) regarding usage of images.

    • Guidelines for attendee photography/videography (e.g., no drones, no commercial gear without permission).

  • Code of Conduct / Prohibited Items

    • Behaviour expectations: respect, safety, no illicit substances, etc.

    • List of items not permitted: weapons, drones, large kites outside specified zones, alcohol (if applicable), etc.

    • Crowd safety rules and kite-flying limits (height, distance, near power lines, etc).

  • Privacy Policy / Data Collection

    • What personal information is collected (ticket purchase, email sign-up, vendor application).

    • How it is used, stored, shared (if at all), and rights of the individual (access, deletion).

    • Third-party links, cookies, analytics.

  • Vendor & Sponsor Agreements

    • Terms for vendors participating (setup, tear-down, liabilities, insurance, booth rules).

    • Sponsorship commitments, usage of logos, promotional mentions.

  • Force Majeure / Weather Contingency

    • Due to outdoor nature, power to postpone, alter, cancel event due to weather, wind, or other unforeseen events.

    • Statement that tickets may not be refunded fully in all circumstances (or the conditions for refund).

  • The festival takes place at:

    We are committed to ensuring that the location is accessible to all guests, including those with disabilities.

  • Parking & Ground Access

  • Accessible parking spaces will be available close to the main entrance for vehicles displaying an appropriate disability parking permit.

  • Drop-off access will be provided for guests who require closer access to the gate.

  • Paths from parking or drop-off points to entrance will be paved or otherwise suitable for wheelchairs, walkers, and other mobility aids.

  • Please contact us in advance if you require parking assistance or reserved accessible parking.

  • Entrance & Movement On-Site

  • Entry gates will include at least one accessible entrance lane for guests using wheelchairs or mobility devices.

  • Event grounds will feature accessible routes (ramps or level surfaces, as required) to main performance areas, vendor zones, restrooms, and food areas.

  • We will ensure that all pedestrian pathways are kept free of trip hazards and are maintained visible during evening/night events (lighting will be adequate).

  • If you have any difficulty navigating the grounds during the event, please approach the Information/Guest Services booth for assistance.

  • Restrooms & Facilities

  • ADA-compliant (or equivalent) restrooms will be located on site and suitably distributed to serve accessible routes and all guests.

  • If you require changing facilities or additional assistance, please contact the Guest Services desk for directions and support.

  • All restrooms will be inspected and maintained for cleanliness, lighting and accessibility throughout the event.

  • Seating & Viewing Areas

  • Designated accessible viewing areas for performances (including evening glow/lighting shows) will be provided. These areas will be on level ground, with stable surfaces and good sight-lines.

  • Companion seating (one guest accompanying the accessible guest) will be made available.

  • Accessible bleachers or platform access (if applicable) will have ramps or lifts to meet mobility needs.

  • Service Animals & Assistive Devices

  • Service animals (as defined under the Americans with Disabilities Act) are welcome throughout the festival grounds. Please ensure the animal is under control at all times.

  • Guests may bring manual or powered wheelchairs, scooters, walkers and other assistive mobility devices. If you are using a large personal mobility device, please notify Guest Services in advance so we can ensure safe access and routing.

  • If you use hearing or vision assistance (e.g., hearing aids, visual guide aids), and require special accommodation (such as captioning, sign-language, or tactile/large-print materials), please contact us at the email or phone below and we will do our best to assist.

  • Notifications & Communication

  • Above-ground signage will include high-contrast graphics and readable font sizes; maps of accessible routes will be posted at Guest Services and online.

  • Should there be any change in schedule, location of accessible areas, or other modifications (for example due to weather), we will provide timely updates on our website and at the festival info desk.

  • If you require printed materials in large-print, Braille, or other accessible formats, please let us know in advance.

  • Planning Ahead
